Wonder SHOP – Terms and Conditions

1. General terms and conditions

Wonder SHOP is an online store of Jasu Wonder World, a company founded by Jasmine (Jasu) Hintsala (business number 2786742-1). Wonder SHOP runs on www.jasuwonderworld.net. Seller: Jasu Wonder World (Jasmine Hintsala), Business ID 2786742-1, VAT number FI27867421, Pohjavedenkatu 4 A 20, 00980 Helsinki, Finland, email jasuwonderworld@gmail.com. These general terms and conditions are applied between Wonder SHOP and its Clients.

By using Wonder SHOP, ordering products on the online store or registering as a user, the Client accepts these general terms and conditions and agrees to act according to them. Wonder SHOP online store is presented to the Client the way it is at any given moment on www.jasuwonderworld.net

2. Consumer protection

The Client of Wonder SHOP can be a private individual (consumer) or a company or other organisation. Our dealings with consumers are governed by the Finnish Consumer Protection Act and the other consumer protection legislation in force at the time. Nothing in these terms limits the rights that consumers have under mandatory law. With business customers, these terms apply first and the trade law in force at the time applies second.

3. Client’s personal information and privacy protection

When a Client is doing business in Wonder SHOP, some information, such as purchase history, will be saved in the customer register. The way this information is handled and what it is used for are stated in the privacy statement. The Privacy Statement clarifies the Client’s rights and their chances to influence the way their personal information is handled. The Privacy Statement can change if www.jasuwonderworld.net or general legislation changes.

Registering as a Client on Wonder SHOP or ordering products from the online store require the Client to provide www.jasuwonderworld.net at least their name, address, email address and phone number. The information provided by the Client is saved in the customer register of Jasu Wonder World. The Client is responsible for making sure their information is accurate and notify if anything about their personal information changes.

Jasu Wonder World is responsible for handling Clients’ personal information properly. The information is used to deliver orders, look after the customer relationship and meet legal obligations such as bookkeeping. We send marketing emails (such as newsletters) only if you have agreed to receive them, and you can unsubscribe at any time.

Jasuwonderworld.net uses cookies. Necessary cookies keep your basket and login working, so the shop cannot work without them. Analytics cookies (Google Analytics) are used only if you choose “Accept” in the cookie banner, and you can change your choice at any time via “Cookie settings” at the bottom of every page. More in the cookie policy.

4. Registering as a Client and account creation

By filling a registration form on www.jasuwonderworld.net the Client creates their own personal account that they can access with their account name and password.

The Client is responsible for protecting their account name and password so that no one else can have an access to their account or use it. The Client is responsible for all the orders and payments made through their account.

The client can get their account removed anytime. This can be done by sending a removal request to jasuwonderworld@gmail.com. Jasu Wonder World can terminate any account if that is considered a justified action. Such action can be taken for example in any case of improper use or abuse.

A Client can also place an order on Wonder SHOP as a guest, without registering and creating and account. In this case no personal information will be stored on the website for later use.

5. Placing an order

When you place an order on Wonder SHOP, the order is confirmed once your payment has been verified, and you receive an order confirmation by email showing what you bought.

Wonder SHOP may decline an order before it is confirmed. After confirmation, we may cancel an order, or part of it, only for a justified reason, for example if a product has sold out, if there is an obvious pricing error (see section 6) or if we suspect misuse of a payment method. If we cancel, we tell you without delay and refund what you paid for the cancelled part within 14 days at the latest.

Notice that special conditions apply to the purchase of original paintings (see 15. “Conditions for purchasing an original painting”)

6. The pricing of the products

The prices of the products of Wonder SHOP are seen on www.jasuwonderworld.net website in the products’ information at the moment an order is being placed. The prices include value-added tax, unless stated otherwise. The prices can change anytime except in a case of predetermined campaign that has a certain start and end date. The product prices do not include any shipping fees.

In case of a sales campaign, the special offers are valid only during the given period of time, presuming there are products in stock. If the products on sale run out of stock and are not available, Wonder SHOP is not required to ship the products in question or replace them with any other product.

If a product has been shown with an obviously wrong price because of a mistake (for example a typing error), Wonder SHOP may cancel or correct the order. We tell you without delay, and you may cancel the order if you do not accept the corrected price. If we send the wrong product or the wrong number of products, we put it right at our own cost. Wonder SHOP may also decline an order where a product on sale is clearly being bought in large quantities for resale. In all these cases, any payment for cancelled products is refunded within 14 days.

7. Making a payment

To pay for an order, Wonder SHOP provides several different ways to make a payment. All the payment methods available are visible on Wonder SHOP when placing an order. Wonder SHOP only provides payment methods that are reliable and trustworthy.

8. Shipping

To ship the orders, Wonder SHOP uses Finnish postal service (Posti Group Oyj). The shipping fee is added to the price of the order. The cost of shipping is displayed when confirming an order, before the payment is being made.

The delivery time of an order may vary depending on the availability of products. If an ordered product turns out not to be available (for example because a campaign product sold out or a stock figure was wrong), we tell you without delay and refund the payment for that product within 14 days, or, if you prefer, send it when it is available again.

An order may be sent in several parcels if we find it appropriate; you are not charged extra shipping for this. Handmade and made-to-order products can take up to a week to prepare before shipping, and if the wait will be longer than a week, we tell you. Unless another delivery time has been agreed, we deliver within 30 days of the order. If the delivery is late, you may give us a reasonable extra deadline, and if we still do not deliver, you may cancel the order and get a full refund. The goods are at our risk until they have been delivered to you.

Wonder SHOP is not liable for the delay or any other damage caused by force majeure. For Wonder SHOP, force majeure is considered such unpredictable situation or change of circumstances, that is completely outside of its control.

9. Right of withdrawal (14-day returns)

If you are a consumer, you have the right to cancel your purchase within 14 days without giving any reason. The 14 days start on the day you (or someone you name, other than the carrier) receive the goods. If your order arrives in several parcels, the 14 days start when you receive the last one.

How to cancel: tell us before the 14 days have passed by sending a clear statement, for example an email to jasuwonderworld@gmail.com. You can use the model cancellation form below, but you don’t have to.

Returning the goods: send the goods back without undue delay, and no later than 14 days after telling us you are cancelling, to:

You pay the cost of returning the goods. Please pack them carefully so they arrive undamaged. You may handle the goods the way you would in a shop to look at them, but you are liable for any loss in value caused by handling them more than that (for example using, washing or damaging them).

Your refund: we refund everything you paid, including the original delivery cost for the cheapest standard delivery we offer, within 14 days of receiving your cancellation. We may hold the refund until we have received the goods back or you have shown proof that you sent them, whichever happens first. We refund using the same payment method you used, unless we agree otherwise, and you will not be charged any fees for the refund.

When the right of withdrawal does not apply: goods made to your specifications or clearly personalised for you, such as commissioned artworks and portraits, products with text, images or other changes added at your request, and products made in a size or version that is not one of the standard options in the shop. The right of withdrawal also does not apply to digital downloads (such as eBooks) when, before paying, you have agreed that the download is available immediately and that you therefore lose the right of withdrawal; we confirm this in the order e-mail.

Business customers do not have a right of withdrawal (see section 11).

10. Faulty products (liability for defects)

If a product is faulty or does not match what was described or agreed, you have the rights given to consumers by the Finnish Consumer Protection Act (chapter 5). These rights do not depend on any separate warranty and are not limited to a fixed period: what matters is how long a product of that kind can reasonably be expected to last.

Please tell us about a fault within a reasonable time after you notice it (a notice within two months is always in time) by emailing jasuwonderworld@gmail.com, preferably with a short description and a photo. We will then repair or replace the product or, if that is not possible or reasonable, give you a price reduction or cancel the purchase and refund you. We pay the cost of returning a faulty product.

Normal wear, or damage caused by using the product in the wrong way or against its care instructions, is not a fault. You may also be entitled to compensation for damage caused by a fault, as provided by law.

11. Exceptions in terms and conditions with business customers

With business customers Jasu Wonder World's liability for errors is limited to the price of the products ordered. Wonder SHOP is not liable for consequential damages such as loss of income. For business customers, consumer protection legislation is not applied. Thus, such parts in these terms and conditions that refer to consumer protection legislation do not apply to business customers.

12. Force majeure

Wonder SHOP is released from the obligations stated in these general terms and conditions if it encounters force majeure. Wonder SHOP is not liable for any inconvenience caused to the Client as a result of Wonder SHOP not being able to carry out the obligations stated in these terms and conditions due to a force majeure. For Wonder SHOP, force majeure is considered such unpredictable situation or change of circumstances, that is completely outside of its control.

13. Changes to the services and to these terms and conditions

Jasu Wonder World can alter the website www.jasuwonderworld.net or its contents or these general terms and conditions if necessary. The terms and conditions that are valid are available on Wonder SHOP at the time of placing an order.

14. Dispute resolution

We try to solve every disagreement by talking with you first, so please contact jasuwonderworld@gmail.com. If we cannot agree, a consumer living in Finland can get free help from the consumer advisory service (Kuluttajaneuvonta, www.kkv.fi) and can take the dispute to the Consumer Disputes Board (Kuluttajariitalautakunta, P.O. Box 306, 00531 Helsinki, www.kuluttajariita.fi). Consumers in other EU countries can get help from the European Consumer Centre in their own country.

Disputes taken to court are handled by the Helsinki District Court. A consumer living in Finland can also take the case to the district court of the area where they live, and consumers living in another EU country keep the protection of the mandatory consumer laws of that country.

15. Conditions for purchasing an original artwork

The Client becomes the owner of an original artwork once they have paid its full price.

Having paid the full price of an original artwork, the Client becomes the owner of the specific piece of art but does not own its copyrights. The Client has no right to copy or duplicate the artwork for any such monetary or promotion purposes, that would in any way help them achieve any financial benefit. This right belongs only to the Artist (Jasmine Hintsala), who remains the sole owner of the copyrights of the sold artwork.

The Client can purchase the full copyrights of an artwork. This is done by a separate agreement. The Client will receive a document signed by the Artist to prove the copyrights have been given away.

As the owner of an original artwork, the Client has the right to sell the original piece.

The Client can take photos of the original artwork for private matters only. All photographs meant for such monetary or promotion purposes, that would in any way help the Client achieve any financial benefit, are forbidden. This right belongs only to the Artist, who remains the sole owner of the copyrights of the sold artwork.

Original artworks bought from the shop are covered by the same 14-day right of withdrawal as other products (section 9), unless the artwork was made to order for you (a commission). If you return an original artwork, please pack it as carefully as it was packed when sent to you.

Original artworks can also be paid in instalments by separate agreement; contact the Artist at jasuwonderworld@gmail.com or +358 46 938 9546. The artwork stays the Artist’s property and is delivered when the full price has been paid. If you decide to stop paying, you can cancel the agreement and we refund what you have paid, minus any reasonable costs stated in writing in the instalment agreement.

Using an artwork, or photographs of it, commercially without the Artist’s permission infringes the Artist’s copyright, and the Artist may claim compensation as provided by the Finnish Copyright Act.

Original paintings sold via auction are additionally governed by the Online Art Auction Terms & Conditions.
